Q: I just read that a woman in New York was awarded $14 million dollars for her wrongful death. How is it that she was awarded so much but never regained consciousness after her malpractice?

A: The case you refer to involved a woman who died shortly after the malpractice. You are correct that she did not regain consciousness after her injuries were inflicted upon her. A jury chose to make awards to her spouse and each of her family members totally approximately $4 Million dollars. The jury also chose to award $10 Million dollars for her past pain and suffering. In all likelihood, the trial judge will adjust the past past pain and suffering awards, and it will then be appealed. Whether the family will be successful in keeping most of that award remains to be seen.
