What is a "Plaintiff?"

 

A: Simply, in a negligence, medical malpractice or wrongful death case in New York, it's someone who brings a lawsuit. The person who actually is the injured victim is known in law as the plaintiff.
Likewise, the person or company who has been sued is commonly known as a 'defendant'.
Plaintiff just means the person who is suing.
Defendant just means the person who is being sued.
