A: When a parent dies as a result of negligence or medical malpractice, one of the claims we bring is a claim for loss of parental guidance. We allege that as a result of the wrongdoing, the surviving children (they can be adult children) have now been deprived of mom or dad's love, support and guidance.
While no one can replace the guidance, wisdom and support of a parent, this is a necessary element of damages. This can be proven through other family members by explaining all that the parent did for their kids. Providing advice and guidance is part of what being a parent is all about. Children who do not have that parental guidance have lost something permanent they will never have again.
