A: If you bring a lawsuit, the defense attorneys will do everything possible to dig up dirt online on you. One of the first places they will go will be Facebook. If they can't get onto your Facebook friend list, they will then get you to commit to answers at your question and answer session at your deposition.
After that they will ask the Court to force you to reveal your password for social networks. If your accident or medical malpractice case occurred in NY, there is a very good chance that the Court will agree and require you to disclose that information.
They want dirt on you. They want contradictions to what you have claimed in your lawsuit. They want to show that you have photos and videos of things doing things you say you can and cannot do.
In my office, clients are always advised to stay off all social media during the entire duration of your lawsuit.
