$30.5M malpractice judgment awarded against LMHS Originally posted on February 23, 2007 The parents of a child who was brain damaged at birth won a $30.65 million medical malpractice judgment today against Lee Memorial Health System. The five-week long trial ended with a verdict this afternoon. The case was going on for almost 10 years in the Twentieth Judicial Court. Aaron Edwards, 9, and his parents, Mark Edwards and Mitzi Roden, were rewarded the judgment. They were represented by Christian D. Searcy and Jack P. Hill of the law firm Searcy Denney Scarola Barnhart & Shipley PA. "This case has been crying out for justice for nine years," said Searcy. "We're very confident our lawmakers will conclude that this result was a just one for Aaron and his family - and a beneficial result for the community as well. Our healthcare system simply cannot tolerate the kind of egregious malpractice that occurred at Health Park Hospital in September 1997." According to the lawsuit, Lee Memorial Health System clearly failed to adhere to its own policies and procedures regarding protection of the patient during administration of pitocin. No employees were disciplined since committing the overt malpractice. "Here we have a healthcare institution that claims to have never been successfully sued for malpractice in its history, then refuses to acknowledge such an obvious lapse in care that destroyed a child's brain and the life of a family," Searcy said.
