Jensen Farms, the producer of a bacteria-ridden cantaloupe crop that was recalled last year, is now being sued by several poisoned individuals and their families.
The most recent suit is a wrongful death claim from the family of Paul A. Schwarz of Kansas, who died at age 92 of listeria poisoning on December 18. The original claim was filed while Mr. Schwarz was in the hospital against both Jensen Farms and the distributor Frontera Produce. Schwartz had spent over a month in the hospital before he was transferred to a nursing home, where he died.
150 individuals in the United States have been reported sick due to Jensen Farms cantaloupe, including some from New York. 31 deaths have thus far been reported, which makes this the deadliest food poisoning outbreak since 1924.
Jensen Farms had recalled its cantaloupes back on September 14. The FDA later found their Colorado processing plant to have unsanitary conditions.
Listeriosis causes gastrointestinal problems and flu-like symptoms in most people. Pregnant women are at a risk of miscarriage or stillbirth, and the elderly or those with weakened immune systems may suffer more debilitating effects, including fatal meningitis or encephalitis -- both infections of the brain or spinal cord.
