Jury awards $5.2 million for hysterectomy woman calls unnecessary November 11, 2005, 4:48 PM EST WATERBURY, Conn. -- A jury has awarded $5.2 million to a woman from North Branford who says doctors performed an unnecessary hysterectomy after incorrectly diagnosing her with cancer. Michelle DiLieto had a hysterectomy in 1995 after being diagnosed with a potentially fatal cancer of the uterus. She sued her gynecologist and Yale University School of Medicine in 1997 after a Boston-area doctor looked at her case again. "Im just so happy that justice was done after all these years and a long journey," DiLieto said after the jury returned the verdict. "I never had that cancer, and everyone knows it now." DiLietos attorney said she suffered permanent nerve damage from the surgery. Jurors found Yale liable for $2.5 million, and Dr. Scott Casper and his practice, County Obstetrics and Gynecology Group, liable for $2.7 million. Yale spokesman Thomas Conroy said the university plans to appeal. A jury had already heard the case in 2000, but could not reach a verdict against Casper. Jurors sided with Yale and DiLieto appealed to the state Supreme Court, which reversed that part of the judgment. "This matter has been tried twice, and on the first occasion, the jury found for the defendants," Conroy said. "We believe that was the correct verdict." A message seeking comment was left at Casper's office.
