Jury awards Port couple $8M damages A state Supreme Court jury awarded a Port Jervis woman and her husband nearly $8 million in damages in a judgment against a Middletown doctor. The jury delivered its verdict Monday after a trial that lasted a little over a week. Nancy McTiernan, 56, was the key witness, testifying from a wheelchair in a muffled voice as she described the consequences of her treatment by Dr. Asadolah Baradaran. She told the jury that in 2001, after she developed problems with her coordination, Baradaran referred her for surgery to correct a bulge in her neck. It turned out that she actually had breast cancer. The breast cancer was diagnosed several months later. Her lawyer, Alan Fuchsberg of New York City, presented evidence to the jury that before the cancer was discovered, McTiernan developed paraneoplastic syndrome, a condition in which antibodies reacting to a cancer tumor cause damage to the organs. The syndrome was arrested after McTiernan had breast-cancer surgery in 2002, but she had already suffered severe brain damage and was rendered unable to care for herself. Baradaran's lawyer, Donald Scialabba of White Plains, couldn't be reached yesterday to discuss the verdict.
