Video Library

Contained within this video library are literally hundreds and hundreds of educational videos to help you understand how lawsuits work in the state of New York. No matter what type of accident or medical malpractice case you may have, these videos provide you useful information that will make you a better-informed consumer. My goal, when creating these videos was to educate you and teach you about these cases. I originally started creating these videos because there was nobody else anywhere who was educating public online and teaching viewers the step-by-step process that occurs in these cases.

As you know, these videos are not meant as legal advice at all. Rather, they are designed to explain how lawsuits work. I have videos here that range from what an attorney looks for in evaluating a case to videos about how we actually prepare the papers necessary to start a lawsuit to trial practice and cross examination and many more!

I have found that people who come to my website spend a tremendous amount of time here because of all the useful information that explains how the process works here in New York. I have potential clients call me and e-mail me all the time thanking me for educating them and teaching them about this.

Finding the right attorney can be a difficult task.     Most callers to my office are unfamiliar with the purpose of their initial phone call. I typically will ask a few key pointed questions to learn some basic information.     When you first call my office to ask for information, that first call is a screening call. My goal is to determine, in quick fashion, what you think was done wrong that caused you permanent harm.

  • What is What is "Causation?"
    Did you know that if you are unable to prove causation in your case, you will be thrown out of court without receiving a dime in compensation? It's true.

    Causation is that critical link between the wrongdoing and your injury.

    In New York we must show that carelessness (or negligence) was a substantial factor in causing or contributing to your injury. If it was not, then a jury will never get to compensate you. If it was a substantial factor in causing your injury, then the jury is obligated to award you compensation.
  • Is Your Doctor An Expert Qualified To Tetsify At Trial?Is Your Doctor An Expert Qualified To Tetsify At Trial?
    In the old days you would have to get the court to qualify your doctor as an "expert" in order to allow him or her to testify during a trial.

    You would have to present the doctor's qualifications and then formally asked the court "Your honor, I ask that Dr. Jones be qualified as an expert before this court."

    That formality has pretty much been done away with in New York state courts. Instead, you still have to present the doctor's qualifications to establish that he has a basis upon which to render opinions and conclusions.

    However, it is now the jury's decision whether to believe the doctors credibility and qualifications. The jury is allowed to weigh each of those factors to determine whether to accept or reject the expert's testimony.
  • Can You Bring a Pediatrician In To Testify Against a Surgeon?Can You Bring a Pediatrician In To Testify Against a Surgeon?
    Your case involves a surgical error. Is it acceptable to bring in a pediatrician to testify in your surgical malpractice practice case?

    The answer is no. Ideally, you want to bring in a medical expert who has the same type of qualifications as the doctor that you have brought a lawsuit against.

    That type of physician will best know what the standards of medical care are compared to a doctor who does not specialize in that field of medicine.

    If a pediatrician were to try and testify in a case involving claims of wrongdoing against the surgeon, he would be destroyed on cross-examination.

    It would not matter that the pediatrician may have some knowledge of the standards for a particular surgical procedure.

    If your case involves surgical error, then you would want a well-qualified board certified surgeon to come in and explain that he does this procedure all the time and is very familiar with the standards of care regarding this particular procedure.
  • "Doctor, Is This Textbook Authoritative?"
    If you ever sat in on a medical malpractice trial here in New York, during cross examination of a medical expert, you would hear the question "Doctor, do you consider this textbook to be authoritative?"

    The answer is a significant one for the doctor. If he says no, then the attorney who is cross-examining him cannot ask him questions about statements in the textbook and whether he agrees or disagrees with the positions in the textbook.

    If he agrees that the textbook is authoritative, that means that the trial attorney can now ask him questions about different statements in the book and whether he agrees or disagrees with them.

    One of the more fascinating tactics to use at trial is bringing in an entire stack of seven or eight medical textbooks. Then, asking the doctor whether he recognizes each textbook as being an authority in its field.

    After the first two or three textbooks that the doctor discards as not being authoritative, the jury quickly understands that no matter what textbook you pull out, the doctor is going to refuse to accept any textbook as authoritative.

    Although the doctor will be prepared to give explanations about why these textbooks are not authoritative, the jury will begin to wonder what's going on.

    Have you ever seen a lawyer use a transcript at trial during cross-examination?
    You haven't?
    Let me tell you how it can be used at trial.

    A transcript is a series of questions and answers put together into a booklet. The questions and answers are given under oath, usually at a pre-trial hearing known as a deposition or an 'examination before trial'.

    The experienced trial attorney will use prior sworn testimony to show inconsistencies with what a witness is saying at trial. This can be a very powerful way to show a witness has taken a different position than the one they are now discussing.

  • "Judge, I Offer These Records Into Evidence"
    Have you ever watched a trial and the attorney says "I offer this report into evidence," and the defense lawyer jumps up and says "Objection!"

    Of course you have. In this video I describe why the attorney is objecting and what needs to be done to overcome the objection.

    Did you know that in order to admit your medical records into evidence you need to bring into court a medical records witness to testify about the accuracy of your medical records? A witness is also needed to explain how the records are maintained in the ordinary course of business.

  • Judge Charging Jury-DO NOT ENTERJudge Charging Jury-DO NOT ENTER
    What does that mean?

    It means that the judge is giving the jury instructions on the law in New York. It means that the case is almost over and the jury is just about ready to go and start deliberating on their verdict.

    Before they can start deliberating, they must listen to the law that applies to that particular case.

    More importantly, did you know that each attorney has an opportunity to ask the judge to give specific instructions that favors his or her client? It's true.

    In fact, the judge is required to ask the lawyers if they have any specific instructions they want the judge to discuss with the jury.

    The judge will then decide whether those requests will be honored. That takes place in the Judge's private office with a court stenographer present. That's known as a 'charge conference'.

    Avastin was touted to be the miracle cure for breast cancer patients. It had been proven to choke off the blood supply of the tumor in other types of cancers and had been approved for breast cancer treatment. Avastin happened to be the most popular and best-selling cancer treatment drug for breast cancer. The FDA recently pulled the drug off market because of recent studies that confirmed that the risks far outweighed the benefits.

    Recognizing that possibility, the FDA said that this medication can be prescribed by a doctor "off label." What that means is that there are significant risks associated with the medication and doctors can still prescribe it for their patients as long as they recognize significant potential for suffering injury.

    Continuing to take this medication will be an extremely expensive proposition. Your health insurance company will likely no longer pay for this medication that costs almost $100,000 per year. According to news reports, Medicare will continue to make payments for the medication, but it is unclear for how long they will continue to do so.

The woman had complained of a lump in her breast and she was correctly referred for a mammogram. The mammogram results were interpreted as "normal" but her lump continue to grow. She was then referred to a breast surgeon for biopsy. Unfortunately, the surgeon failed to biopsy the actual lump, and instead got surrounding tissue which was read as "normal." After being reassured by various doctors that she only had cystic breasts and there was no cancer, she gave no further thought to her growing mass in her breast. Finally, the mass became so pronounced that upon further evaluation, she learned that she had stage IV breast cancer.     When something unusual or untoward happens in a hospital, the staff is required to fill out an incident report. Anyone who witnessed the event or participated in the event will usually contribute to filling out an incident report.

    The problem is trying to get a copy of that incident report. The hospital attorneys argue that the report is "Privileged" and protected from prying eyes by the NYS Public Health Law.

    The problem for injured victims is that they're right. That means that the hospital will not release the report. The reason? It's designed to allow the staff to discuss freely what happened without fear of legal retribution.

    It's primarily designed to improve patient care so that events like those that happened do not happen again.

     a patient working in a Brickyard fractured his arm while driving a forklift. He went to a local emergency room where they correctly diagnosed that he had a fracture of his forearm. They put them in a cast and told him to follow up in the orthopedic clinic. He did that.

    Every time he returned to the orthopedic clinic they took x-rays and told him that his arm is healing beautifully.

    Seven weeks later, the patient has just removed and instead of his arm being straight as it should be, it looked like a roller coaster. The patient asked the doctor why his arm looked so strange. The doctor told him that with a little massage and physical therapy it would be just fine. This was not true.

    A prompt visit to an orthopedic surgeon revealed that the patients broken bone was never properly reduced and was instead allowed to heal in an incorrect position. Also troubling was the fact doctors and clinic never recognized and follow-up x-rays that the patient's arm was not correctly aligned or position.

    As a result of this carelessness, the patient had to have surgery to read-great bone and then reattach it using titanium rods and screws. He was now left with a surgical scar as well of restriction of motion. Watch the video to learn more.

    Your loved one has died in New York, and you are devastated. You believe that your family member died because of someone's wrongdoing.  You want answers.

    In cases where your loved one was elderly and not working, then it becomes difficult, if not impossible, to show that there was a financial loss to the family as a result of their death. This is known as "pecuniary loss." In NY, one of the elements of proving a wrongful death case include asking "What was the financial loss to the family because your loved one died?"

    Where the person was not employed, then there is no way that we can show an actual financial loss to the family, unless there was some other source of income that they were receiving on a regular basis.

    Another element that we look at in a wrongful death case in New York is to determine whether your family member suffered pain, from the time of the wrongdoing until their death. If they were under anesthesia during the course of surgery, and something happened during surgery to cause their death without them ever waking up, then it would be difficult, if not impossible, to show that they were conscious and aware of what was happening. In order to prove conscious pain and suffering and be able to include that in a claim for wrongful death, we must be able to show some level of awareness and pain. The NY Courts have held that this can include moaning, groaning and responses to painful stimuli.

    You undergo surgery and after leaving the hospital you have continued complaints of abdominal pain. Thinking it's normal, you ignore it for a day or two but it continues to get worse. You call your doctor's office and are told it is normal postoperative pain. Despite taking pain medication and resting, you get weaker, and your pain gets stronger. If you're lucky, you'll get to an emergency room to be evaluated. When the doctors suspect that there is a hole in your bowel, you'll have to go back into surgery. If the contents of your bowel were leaking from a hole, you'll likely need to have part of your bowel removed and the remaining bowel sewn together. The failure to recognize a bowel perforation is often grounds for a medical malpractice lawsuit in New York. If caught early enough, treatment can be effective although prolonged and distasteful. Those unlucky enough to get to a hospital on time, suffer the indignity of death from an unrecognized bowel perforation. Watch the video to learn more.
