In a trial, does the Judge determine how much money I will be awarded?


A: In practically every accident and malpractice matter I have handled, I always ask for a jury trial. This means that a jury of your peers (members of the community) will be deciding the issues in your case. The jury will be deciding whether you will receive money and if so, how much. The trial judge still has the ability to modify any award that is made by the jury. In a case that is decided solely by a Judge, then the Court would make a determination of how much you are to be awarded, if anything.
