If I have a valid case that has been confirmed by a medical expert, is there any way to avoid litigation to get compensated?
The short answer is maybe. The longer answer is more complicated.
There are some insurance companies in New York (and even the New York City Health and Hospitals Corporation, NYCHHC) who have established programs to evaluate certain cases at very early stages of investigation and/or the early stages of litigation.
Some people call it the early settlement unit. However, do not be fooled by the name. Just because you submit your case to the early settlement unit DOES NOT MEAN THAT YOUR CASE WILL SETTLE. Nor does it mean that they will roll over and accept whatever it is that you are claiming. Nor does it mean that they will accept your idea of what your injuries and/or damages are. They will still fight against you and try to minimize your compensation- especially at the early stages of investigation or litigation.
However, it is a good start to having the defense understand the case at an early stage and begin to negotiate the damages and compensation. Also keep in mind that there are specific cases which can and will settle at this early stage.
