The answer may surprise you.

Did you know that there is no objective way to truly know who is the “Best” medical malpractice lawyer in New York?

There is no standardized test that every medical malpractice trial attorney takes. It's not like taking the SATs or some other test that can be graded from 0-100.

Wouldn't it be great if all lawyers New York took such a test and the lawyers who scored 100 could be given the title of “best lawyer” and the lawyers who scored zero would be given the title “worst lawyer.”

The reality is that there are excellent lawyers with great records of success. However, the key question for you is whether that lawyer is right for you. Remember, every lawyer is supposed to tell you that past records of success are no guarantee of future success. In other words, just because an attorney has achieved a good result on a particular case does not mean he can achieve the same type of result for you and your case.

Obviously you want to hire an attorney who has a good track record and has the experience needed to handle your particular type of case.

However, it's important to keep in mind that not every lawyer is right for every client.

Some clients prefer lawyers who work in large law firms. Others prefer attorneys who are solo practitioners. There are also different personalities that are involved when choosing an attorney.

ASK 5 INJURED VICTIMS WHO THEY'D RECOMMEND

Let me give you an example of what happens if you ask five people if they would recommend their lawyers for your matter.

Let's say there are five injured victims who brought lawsuits. Those five victims were very pleased with the outcomes that their attorneys were able to achieve. If you were to ask any one of those injured victims whether they would recommend their attorney and what they thought of their attorney, here is the likely response:

“You should go to my attorney because he is “the best lawyer in New York.”

How exactly can you confirm that their lawyer is “the best lawyer in New York?” The answer is that you can't. These are perceptions. These are beliefs based upon their own experience. While that may be a good indicator of what the attorney has been able to achieve in the past, it does not necessarily mean that lawyer is right for you. 

The best lawyer for you may be one who has a good track record and one who fits your personality.

DOES THE LAWYER AND LAW FIRM HAVE THE RIGHT PERSONALITY FOR YOU?

Here's what I mean.

If you're the type of person who needs to have their hand held all the time, then you may not want to go to a large law firm. If you get offended when you call your law firm and the receptionist asks “How do you spell your last name?” That law firm may not be right for you. If you don't mind having your case handled by paralegals, caseworkers, junior associates and staff attorneys, then going to a large law firm may be right for you.

On the other hand, if you want one attorney to work on your case from the start all the way through trial, then going to a solo practitioner might be the best attorney for you.

WHO IS THE "BEST" ATTORNEY?

The title of this article “Who is the best medical malpractice trial lawyer New York?” may not have been artfully worded. It should probably be titled “Who is the best medical malpractice trial lawyer in New York for you?”

Only you can answer that question.
